    Banking

    The FMA regulates certain products that may be offered by banks (e.g. managed funds) to you. The FMA is interested in the overall conduct of banks. THe FMA does not have a direct legislative mandate for regulating the conduct of providers of core retail banking (such as lending, credit and bank accounts).

    Standards for designated Financial Market Infrastructures

    The standards for designated FMIs were issued on 27 July 2023 under sections 31 and 34 of the Financial Market Infrastructures Act 2021 (the FMI Act) by the Reserve Bank of New Zealand and the Financial Markets Authority acting jointly as the regulator under section 9 of the FMI Act. The standards come into effect starting from 1 March 2024.

    Levies and waivers

    The FMA receives funding from the Crown and a proportion of our costs is recouped from industry through levies. The Financial Markets Authority (Levies) Regulations 2012 (the Regulations), as amended in 2020 and 2022, set out the levies payable by industry.     Climate Reporting Entities (CREs)

    The New Zealand government has introduced a new regime making climate-related disclosures mandatory for some organisations. Organisations covered (known as Climate Related Entities or CREs) will have to make annual disclosures covering governance arrangements, risk management, strategies and metrics and targets for mitigating and adapting to climate change impacts. The requirement applies to the larger publicly listed companies, big insurers, banks, non-bank deposit takers and investment managers. Read more on the FMA website.

    Single adviser business

    Business or individual with financial advisers

    Business or individual with financial advisers is a way you can operate under the new financial advice regime.     Declaration form to be completed by an individual relevant party such as an owner when applying for a market services licence under Part 6 of the Financial Markets Conduct Act 2013 (FMC Act) and disclosure is required by relevant parties, as defined in regulation 189 of the Financial Markets Conduct Regulations 2014 (Regulations).
